MORMUGAO MUNICIPALITY

This Memorandum of Understanding is signed between the Mormugao Municipal Council, a corporate body constituted under the Goa Municipalities Act, 1968, represented by Chief Officer Shri Elvis Gomes (hereafter MMC) and People for Animals-Goa, a Society registered under the Societies Act, 1860 represented by the President Smt Norma Alvares (hereafter PFA) on this 3rd day of June 2003 regarding establishment of an Animal Shelter for animal welfare and conducting Stray Dogs Birth Control Programme (hereafter Programme) in the municipality.

The parties here above agree to perform and deliver the here below written:

MORMUGAO MUNICIPAL COUNCIL

1. Mormugao Municipal Council shall allot sufficient land along with structure in its Property in Chalta No.1 (Part) of P.T. Sheet No.147 adjoining to the four-lane road at Shantinagar, Vasco-da-Gama for the purpose of setting up animal shelter.

2. The land so allotted will be at the disposal of PFA solely for the purpose of running the animal shelter and shall not be utilised for any other purpose at any time. PFA will be fully responsible for the management of the shelter and the programme.

3. Mormugao Municipal Council provide clear access to the animal shelter for the members, volunteers, staff and vehicles engaged in programme.

3. Mormugao Municipal Council will make available water and electricity connection to the shelter. The monthly electricity and water charges will be borne by PFA.

4. Mormugao Municipal Council will provide 4 municipal staff for the programme. They will be trained in dog catching and attendant duties by PFA and will be under the control and supervision of PFA. In the alternative, Mormugao Municipal Council will pay the salaries of 4 workers engaged by PFA (@ Rs. 3000 per worker).

5. Mormugao Municipal Council will pay petrol costs of Rs. 2000 per month for transportation of stray dogs to the shelter.

PEOPLE FOR ANIMALS

1. PFA will equip the animal shelter with necessary facilities and will meet all operational expenditure other than that specified above to be the responsiblity of the Mormugao Municipal Council.

2. PFA will pay the electricity and water charges at the shelter.

3. PFA will repair and refurbish existing structure so as to make them useable for operation of animal dispensary and functional office.

4. PFA will organise regular impounding of dogs from any part of the municipality and transport them to the shelter in accordance with the Programme.

5. PFA will operate, immunize and take care of animals detained at the shelter and will arrange food for the detained animals.

6. PFA will arrange for veterinary doctor for the programme.

7. PFA will cover 1,500 dogs per annum under the programme.

8. PFA will furnish detailed reports of dogs sterilised, immunised and euthanised per month to enable the Mormugao Municipal Council to monitor the progress of the programme.

9. PFA will give first preference to complaints received from the office of the Mormugao Municipal Council and its directives from time to time.

GENERAL

1. This MOU recognises that the shelter set up to control the stray dog population in the Municipality, is a joint programme of Mormugao Municipal Council and PFA and is meant solely for the purpose of welfare of society and animals.

2. The ownership of the land will at all times remain vested in the Mormugao Municipal Council. Mormugao Municipal Council will provide NOC from time to time as may be required by PFA for the purpose of arranging facilities like telephone connection and other essential services, which are required for the functioning of the shelter.

3. Mormugao Municipal Council will allow the use of the land for animal shelter without interruption for the duration of the programme which is estimated to be three years. It shall be open to Mormugao Municipal Council to request PFA to continue the programme / animal welfare activities beyond the period of three years and the PFA will make all efforts to comply with such request.

4. In the event of the Mormugao Municipal Council reclaiming the land allotted to PFA for shelter the Mormugao Municipal Council will compensate PFA as far as fixed assets only are concerned.

5. If at any time the programme ceases to continue on the site allotted the land will revert to the Mormugao Municipal Council and no compensation shall be claimed by PFA.

This Memorandum of Understanding will be effective for a period of three years and is subject to renewal thereafter if so desired by both parties.

PANJIM MUNICIPALITY

This Memorandum of Understanding (MoU) signed between the Panjim Municipal Council, a Corporate body constituted under the Goa Municipalities Act, 1968, represented by Chief Officer Shri K.A. Satardekar (hereafter PMC) and People for Animals, a Society registered under the Societies Registration Act, 1860, represented by the Secretary Smt Angela Kazi (hereafter PFA).

This MOU was felt necessary due to understanding arrived by both the parties regarding establishment of an Animal Shelter for conducting animal welfare and ABC Programme.

The parties there above has agreed to perform and deliver the here below written:

PANJIM MUNICIPAL COUNCIL

The Panjim Municipal Council shall allot sufficient land along with two room structure in its property in chalta No.18 P.T.S. No.104, chalta No. 1/A P.T.S. No.102, chalta No.1, P.T.S.
o.103, adjoining to Hindu crematorium for purpose of conducting Animal Shelter and ABC Programme (Council resolution dt. 28.5.99)

1. All requirements including fully equipped operation room and dispensary shall be funded by PFA.

2. The PMC will allot land at disposal of PFA solely for purpose of running the Animal Shelter and ABC Programme. The land so allotted shall not be utilised for any other purpose other than specified.

3. PMC shall have no role in the day to day management of the shelter. It will be sole responsibility of PFA.

4. Since this is a joint project of PMC and PFA no rent or fees or charges will be paid by either parties and the project will be solely for the welfare of the society and animals, with sole aim to prevent cruelty to the animals.

5. The ownership of land all the time will remain in possession of PMC.

6. The PMC will pay charges of electricity and water and whenever feasible invest in fixed assets like cages, sheds, etc. from time to time.

7. The PMC will provide the services of dog catchers approximately four in numbers and train them at appropriate place.

8. The PMC shall also provide sheds to house impounded dogs during the period of detention for sterilisation and immunisation.

9. PMC will provide vehicle and a driver for transportation of dogs to the animal shelter. Till a vehicle is procured by PMC the van of People for Animals will be used.

10. PMC will provide services of one veterinary doctor from Department of Animal Husbandry and Veterinary Services who will attend to sterilisation of dogs at least two days a week and PFA will extend all co-operation to the Government doctor.

11. PMC will provide clear access to the animal shelter for the members and volunteers of PFA all the time.

12. The PMC will make sufficient provision in its budget for the management of animal shelter. The initial provision shall be made of Rs.2,00,000/- during the financial year 1999-2000 and same shall be raised every year.

PEOPLE FOR ANIMALS

1. The PFA will raise its own sufficient resources from the Government and Animal Welfare Board to equip the animal shelter with necessary facilities and to meet operational expenditure.

2. The PFA will refurbish and repair the existing structures so as to make them useable for operation of animal dispensary and functional office.

3. The PFA will organise regular impounding of dogs from any part of the cityand transport it to the animal shelter.

4. PFA will operate, immunize and take care of animals during post-operative period.

5. PFA will arrange food for the detained animals.

6. PFA will arrange its own veterinary officer to carry on the programme set for the welfare of the animals.

7. The PFA shall furnish detailed report of animals sterilised, operated or performed ABC Programme to PMC every month.

8. The PFA will give first preference to the complaints received from the office of PMC and its directives from time to time.

9. PFA will carry on the fixed target set by PMC as far as immunisation sterilisation programme.

GENERAL

1. PMC will make available power and water to the animal shelter.

2. PMC will allow the use of allotted land for animal shelter without interruption.

3. PMC will entrust the management and control of the shelter to PFA.

4. PFA shall establish and manage the animal shelter on behalf of PMC.

5. PFA shall use the land for the purpose for which it is allotted i.e. for animal shelter only.

6. In the event of PMC reclaimed the land allotted to PFA, the Panjim Municipal Council will adequately compensate as far as investments made by PFA.

7. For any reason the PMC wants back the land allotted for animal shelter for its future project than the alternative site shall be allotted to the People for Animals with similar existing facilities.

8. The PFA shall use the land for the sole purpose of animal shelter or any other similar activity connected with the animals and if at any moment this activity is ceased to continue on the site allotted, the land will be reverted back by PFA to the PMC and no compensation shall be claimed.
