Cong’s Panjim candidate discloses his criminal antecedents

Panjim: Congress Panjim by-election candidate Atanasio Monserrate has made public the details of his criminal antecedents, as mandated by Supreme Court.

The declaration comes days after BJP filed an official complaint before the Chief Electoral Officer (CEO) pointing to non-disclosure of criminal cases by Monserrate in media.

As per the Supreme Court judgment passed in September, 2018, the candidates who have offences registered against them are mandated to publish their criminal record, at least three times in newspapers and electronic media, after filing their nomination.

Monserrate, in his affidavit filed before the District Election Officer during the nomination process, had mentioned 10 serious criminal cases under his name under various sections of Indian Penal Code.

However, the candidate has published advertisements in section of local print media detailing out only two cases pending against him before Court which include a minor girl rape case and human trafficking in 2016 and Panjim police station attack in 2010.

The rape case is pending before Sessions Court, which has framed charges against the accused under Section 376, 342, 506 r/w 34 of IPC and Section 4 of POSCO Act and Section 67-B of IT Act. He has been booked for an alleged offence of enticing the victim and alleged sexual intercourse.

The Panjim police station attack case is currently handled by CBI. Monserrate is booked under prevention of damage to Public Property Act 1984, for mobilising people and damaging the police station and causing injuries to police personnel.

BJP, in its complaint, had pointed out that Monserrate, in his affidavit, has clearly declared that there are criminal cases pending against him under various sections of the IPC, POSCO, Income Tax Act, Prevention of Damage to Public Property Act, etc and as per Supreme Court directions, he has to make them public.
