monitoring stations. SPCB directed to notify standards for ammonia in ambient air. As a
consequence, CPCB (also a party to the petition) notifies the standards for the entire
country. ZAC directed to file compliance reports.

therefore liable to be demolished.

Status: Petition allowed by judgement dated 13.7.2000 delivered by Justice F.I. Rebello
and V.C. Daga.
Second phase of the hotel building involving 46 rooms to be demolished. Stay on
demolition while party allowed to appeal the judgement in the Supreme Court. However, no
stay of the directions to the Electricity and Water Departments of the Government of Goa
to cut off electricity and water supply. Hotel ordered to pay Rs.15,000 as costs to Union
of India and Rs.15,000 as costs to the Goa Foundation.
Special Leave Petition No.16664-65/2000 filed by the hotel in the apex court. Notice
issued. Status quo ordered.
10) CHLORINE GAS DISASTER AT CORTALIM

Status: Disposed of by judgement dated 8.2.2000 which directed the Goa government to
consider the claims of the victims for compensation. The Court took the view it could not
consider compensation itself.

11) CONSTRUCTION OF HOTEL GOAN HERITAGE WITHIN 200 METRES OF HTL

Status: Petition allowed by landmark order and judgement dated 13.7.2000 delivered by
Justice F.I. Rebello and V.C. Daga. The judgement is a resounding verdict on the validity
of the Environment Protection Act, 1986 and the CRZ Notification dated 19.2.1991.
New wing of the hotel building to be demolished. First wing and swimming pool allowed.
Demolition stayed to enable party to appeal the judgement in the apex court. However, no
stay on directions to cut off electricity and water supply. Hotel asked to pay Rs.15,000
to Union of India and Rs.5,000 to the Goa Foundation.
Judgement reported: 2000 (2) GLT 187.
Special Leave Petition has been filed in the Supreme Court against the order. Notice
issued. Status quo maintained.
